This paper mentions the debate between Kelsen and Hart about the sanction (punishment) as a structural element or not of the legal norm. Further, this paper pointed out that this debate reflects, among other things, the different philosophical foundations of both authors, the difference between the cultural conception of law in continental Europe and in England, and it shows that Hart try to purify some of the Kelsenian positions in order to consolidate positivism and to locate it better in the context of the Common Law.
